Daniel Lenhoff

Daniel Lenhoff is board-certified in Labor and Employment Law. Now an exclusively management-side attorney, he has previously represented clients on both the plaintiff’s and defendant’s side, with experience in traditional labor law and employment law. He has successfully advised and represented clients in disputes under collective-bargaining agreements, state and federal law, and agency grievance procedures. He uses his experience contesting disputes in formal proceedings to help employers prevent issues from reaching that point and to succeed when those disputes do go to court.

  • First-chaired evidentiary hearings in over a dozen labor union arbitrations, including both discipline and contract-interpretation arbitrations
  • Resolved numerous disputes pre-litigation on client-favorable terms, including through responses to demand letters, mediation, and settlement negotiations
  • Used litigation risk analysis to advise clients on litigation risk and exposure
  • Defended complex wage-and-hour lawsuits under federal and various state laws, including obtaining dismissal of claims and summary judgment
  • Successfully resolved numerous employment discrimination, retaliation, and harassment lawsuits through mediation, settlement, and summary judgment
  • Defended complex ERISA lawsuit through coordination with codefendant plan administrator insurance company, including prevailing on issues of international law and in appeal to the Fifth Circuit
  • Litigated contract claims, including non-compete lawsuits, and advised clients on contract-based indemnity claims
  • Experience using fact investigation to contradict witnesses at deposition, leading directly to immediate and favorable settlement
  • Performed self-audits and internal investigations to assist employers faced with investigations by federal and state agencies
  • Favorably resolved numerous EEOC, Department of Labor, and other agency investigations
  • Trained and updated attorneys and non-attorneys on legal developments, including topics of harassment, FMLA and related leave law, National Labor Relations Board charges for nonunionized workforces, and state immigration laws
